III. RETENTION PERIODS AND LOCATION

We store your Personal Information only for as long as necessary to fulfil the purposes for which it was collected, including for the purposes of satisfying any legal, accounting or reporting requirements. The retention periods we apply are set out below.

A. Orders on the Website

We are generally required under applicable tax and accounting laws to keep records of your orders (including related Personal Information) for up to seven (7) years from the end of the relevant financial year, or longer if required by law.

B. Ordering When Using an Account

We retain order data linked to your account for as long as your account remains active and for the subsequent period required to comply with legal obligations (typically up to seven (7) years). If you close your account, we will remove or anonymise your account-related data where it is no longer needed, retaining only what is required for legal, regulatory or legitimate business purposes (for example, to resolve disputes).

C. Browsing the Website

Visitor and analytics data linked to your device or IP address is generally retained for up to twenty-six (26) months, after which it is either deleted or anonymised, unless a longer period is required for security or fraud-prevention purposes.

D. Newsletter Subscription

We store your Personal Information for marketing purposes until you withdraw your consent (for example, by unsubscribing) or object to receiving marketing communications. We may retain a record of your subscription and unsubscription for a further period (typically up to two (2) years) for compliance and record-keeping purposes.

E. Customer Service

We retain customer service records for as long as reasonably necessary to handle your query and for a subsequent period for internal reporting, training and to defend or establish legal claims (typically up to three (3) years, or longer if necessary). Call recordings (where used) are generally retained for up to three (3) months, unless a longer period is required for a specific investigation or legal purpose.

Location of Processing and International Transfers

Your Personal Information may be stored and processed in the United Kingdom, the European Economic Area (“EEA”), and other countries where we or our service providers operate. This may include transfers to countries outside the UK and EEA (such as the United States) that may not provide the same level of data protection as in the UK.

Where we transfer Personal Information outside the UK/EEA, we will ensure that appropriate safeguards are in place, such as standard contractual clauses approved by the UK Information Commissioner’s Office (ICO) or other legally recognised mechanisms, and that your rights and protections are maintained.

IV. SHARING PERSONAL INFORMATION WITH THIRD PARTIES

We do not sell your Personal Information. We will only share your Personal Information with third parties as described in this Privacy Policy or where required or permitted by law.

B. Compliance With Law

We may use or disclose your Personal Information where we consider it necessary or appropriate to:

  • comply with applicable laws and regulations, court orders or other legal processes;
  • respond to lawful requests from public and government authorities;
  • enforce our terms and conditions or other agreements;
  • protect our operations, rights, privacy, safety or property, or those of our affiliates, you or others; or
  • pursue or defend legal claims.

C. Corporate Transactions or Events

We may disclose your Personal Information to third parties in connection with any proposed or actual reorganisation, merger, acquisition, sale, joint venture, assignment, transfer or other disposition of all or any part of our business, assets or stock (including in connection with any insolvency or similar proceedings). In such cases, we will take reasonable steps to ensure that your Personal Information is treated securely and in accordance with this Privacy Policy.

D. International Processing of Your Information

As part of the Glanbia group, and due to our use of global service providers, we may transfer and process your Personal Information in countries outside your country of residence, including the United States. Where we do so, we will implement appropriate safeguards in accordance with UK data protection law, as described in Section III above.

V. CHILDREN

The Site is intended for use by adults. It is not directed at, and we do not knowingly collect Personal Information from, children under the age of 16. If we learn that we have collected Personal Information from a child under 16, we will take reasonable steps to delete such information as soon as possible.

If you are a parent or guardian and believe that your child has provided us with Personal Information, please contact us using the details set out in Section X so that we can investigate and take appropriate action.

VI. SECURITY

We use appropriate technical and organisational measures designed to protect Personal Information against accidental or unlawful destruction, loss, alteration, unauthorised disclosure or access. These measures include access controls, encryption in transit where appropriate, secure hosting, and internal policies and training.

However, no system or transmission of data over the internet can be guaranteed to be 100% secure. While we strive to protect your Personal Information, we cannot guarantee the security of any information transmitted to or from the Site; any transmission is at your own risk.

VII. ACCESS, CORRECTION AND YOUR RIGHTS

We take reasonable steps to ensure that the Personal Information we hold about you is accurate and, where necessary, kept up to date. Under UK data protection law, you have a number of rights in relation to your Personal Information, subject to certain conditions and exceptions. These rights include:

  • Right of access – to obtain confirmation as to whether we process your Personal Information and, if so, to receive a copy of it;
  • Right to rectification – to have inaccurate Personal Information corrected and incomplete Personal Information completed;
  • Right to erasure – in certain circumstances, to have your Personal Information erased (“right to be forgotten”);
  • Right to restriction of processing – in certain circumstances, to restrict our processing of your Personal Information;
  • Right to data portability – in certain circumstances, to receive your Personal Information in a structured, commonly used and machine-readable format and to have that data transmitted to another controller;

  • Right to withdraw consent – where we rely on your consent to process your Personal Information, you have the right to withdraw that consent at any time (without affecting the lawfulness of processing based on consent before its withdrawal).

You can update certain information (such as your contact details) at any time by logging into your account (if you have one). You can also exercise your rights by contacting us using the details set out in Section X. We may need to ask you to provide proof of identity before we can respond to your request.

We aim to respond to all legitimate requests within one (1) month. If your request is particularly complex or you have made a number of requests, we may take longer; in that case, we will notify you and keep you updated. We may charge a reasonable fee or refuse to act on your request if it is manifestly unfounded or excessive.

VIII. COMPLAINT PROCEDURES

If you have any questions or concerns about this Privacy Policy or about how we handle your Personal Information, please contact us using the details in Section X. We will do our best to address your concerns and resolve any problems.

You also have the right to lodge a complaint with the UK supervisory authority for data protection, the Information Commissioner’s Office (“ICO”), if you are unhappy with how we have used your Personal Information or our handling of your rights:

We would, however, appreciate the chance to deal with your concerns before you approach the ICO, so please contact us first where possible.

IX. CHANGES TO THIS PRIVACY POLICY

We may update or modify this Privacy Policy from time to time, for example to reflect changes in our practices, technologies, legal requirements or for other operational reasons. When we make material changes to this Privacy Policy, we will take appropriate steps to inform you, such as by posting a prominent notice on the Site or by sending you an email notification (if we hold your email address and it is appropriate to do so).

Any changes to this Privacy Policy will become effective when the revised version is posted on the Site, unless otherwise stated. Your continued use of the Site after any changes have been made will constitute your acknowledgement of the updated Privacy Policy.
